Sikyong does not have time for Penpa's trivial court case?
« on: August 23, 2019, 02:40:36 PM »
Well, finally an end to the hearing of this case which has obviously been intentionally dragged out... based on the report, it appears that both parties didn’t really introduce anything (new points or facts). Now, the question is how long before the verdict comes out?

Looks like Penpa Tsering can't really do much to his rival, even if he is at fault. The news report shows Sikyong will most likely get away with what he did. He seems to be not bothered one bit and instead, he is even arrogant about it. From the way the commission responded as to "why the Sikyong never attended a single hearing?" he said Sikyong neither has the time nor the need to attend to such trivial issue while he is taking care of the larger cause of Tibet and enumerated his recent activities visiting England, Baroda, the second Five-Fifty Youth Forum and successfully getting the Tibetan flag hoisted the Bell of Peace parliament to permanently raise Tibet’s flag in its parliament as sign that he is busy.

Wow-what huge slap on Penpa's face. It is kinda like putting Penpa down isn't it? Like it is Penpa the one that's being "petty" here. I doubt this is going to sit easy on Penpa and I don't think the drama is quite over yet. Somehow I don't think Penpa will stop until creating havoc for Sangay even if the court favours him. I guess we better lookout for more drama within the CTA coming.

Case No. 20 wraps up hearing, verdict awaited

DHARAMSHALA, August 21: Case No. 20 wraps up its last hearing today at the Tibetan Supreme Justice Commission (TSJC) after two and a half months.

The hearing today covered the eighth and the last issue of “facts” that needed the Kashag to prove how the former representative exhibited trust deficit, underperformance and insubordination while the plaintiff needs to prove how the defendant’s varied clarifications undermined his sincerity, ability, and good conduct.

The plaintiff enumerated the course of events since his appointment as the Representative following the 2016 Sikyong election to his termination up until now, substantiating all points, major and minor, that “maligned his image.”

After the last argument, the Chief Justice Commissioner, in the conclusion statement said both parties in the case, in accordance with provisions of article 48 of Tibetan Civil Procedural Code, were accorded the opportunity to submit proofs, and argue out the eight issues of facts and two issues of law.

The commission will now revisit the proceedings of all the hearings from the recording and study again before coming to a decision which is expected to take some time.

Responding to why the Sikyong never attended a single hearing, he said Sikyong neither has the time nor the need to attend to such trivial issue while he is taking care of the larger cause of Tibet and enumerated his recent activities visiting England, Baroda, the second Five-Fifty Youth Forum and successfully getting the Tibetan flag hoisted the Bell of Peace parliament to permanently raise Tibet’s flag in its parliament as sign that he is busy.

He chose not to respond to the question of if the Kashag would meet the demand of the plaintiff in case of latter’s victory but admitted that the proceeding of the case was peaceful and orderly.

Plaintiff’s Lawyer Namgyal Tsekyi said the party is confident that they have proved 90% of the issues in the case. Responding to media’s question about how the case may affect the maintenance of public order, she said it is one’s basic right to go to court to seek justice and the public and Kashag alike has the responsibility to respect the verdict of the court.

From this court case we can see that CTA is controlled by one person, the law and the constitution is only a paper guideline. No one can do anything to Lobsang Sangay, as long as he remains as the president. Is CTA really a democratic government or run by a dictator?

Lobsang Sangay is so arrogant, not only he did not attend the hearing and apologise for that. He had to add on to say he is busy doing something more important, i.e. to free Tibet. After so many years, he has not made any progress in free Tibet movement. The worse part is, more countries are cutting their ties with Tibetans and also stop providing them financial aid.

If Tibetans want to make things different, if they want to have a better future, they have to unite and put pressure on CTA. Lobsang Sangay has to know he is the employee of the people, he is not the ruler of the Tibetans in exile.

Yup some guts he has there... basically dismissing Penpa Tsering and putting him down a second time! Huge slap on Penpa's face and I am sure he and his people will not be happy about this. When he said he is busy, it is almost telling Penpa he is just a small fly and doesn't deserve him time or attention. What court? It's definitely being controled by you know who... so basically we're looking at a FAKE democracy administration here.

It is very clear that the "democracy" the Tibetan leadership conveniently professes to be, is just a marketing tool to market its pretty darn obvious independence movement for Tibet.

The three pillars of democracy are the legislature, executive, and judiciary.

By showing disrespect to the third pillar (by not showing up), the Sikyong's version of the three pillars are Sikyong, Sikyong and Sikyong.

Heil Sikyong!

Hahaha this is so hilarious and absolutely true! I wonder will Tibetans have the guts to stand up for something different this time in their next coming elections or will they just follow the Yes man mentality and follow the crowd? I wonder if His Holiness realises he did a huge mistake with this one... or did he not? Hmmmm  ???

Everything is pre-meditated with attained beings, isn't it? So that being the logic, if I go along that way, then one can say that maybe the Dalai Lama knew all along this fake Harvard clown Sangay will trigger something that would expose the CTA's black dark dirty skeletons from the dungeons and all truth will be revealed eventually.

What better way to do it then to get the devil to do its own works and expose the demons within Dharamshala? Hmmmm  ???  Thoughts ???

The CTA is not a democratic body and they are certainly not open for suggestions. They are actually a dictatorship body that only listens to His Holiness the Dalai Lama. No one can ever challenge their authority and those who actually did ended up in a horrible state.

A famous example will be Tulku Drakpa Gyeltsen who was a very famous lama around the 5th Dalai Lama's time. Tulku Drakpa Gyeltsen was a very popular lama back then and his fame even surpassed the 5th Dalai Lama by a little. With jealousy, the 5th Dalai Lama's attendant assassinated this famous lama and confiscated his whole Ladrang.

This will not happen in a democratic country where everyone respects each other's rights. The CTA is still using the same modus operandi even until now. Dorje Shugden ban is discrimination against religion and it breaches the constitution of democracy. Hence, CTA is not a democratic body like how they like to be portrayed as.

Finally, after months, the verdict is out and Penpa Tsering won the court case against Lobsang Sangay. The court says the defamatory allegations made against the plaintiff were unsubstantiated, ordered the defendant to issue apology and clarification the same way through the CTA official outlet! Let's SEE if he will put his ego down and do this? Wow, the president makes a public apology to his rival kakaka  ;D ;D ;D
On top of that, he has to compensate INR 98,700 for the lawyer fees of the plaintiff. LOL

Looks like Sangay is not as "influential" and untouchable as he thinks. This will make a mark on the Tibetan society to be more vocal and daring in asking for justice and going against the CTA. Things are changing and CTA is no longer bulletproof!

Tibetan court rules in favor of Penpa Tsering in case no. 20

DHARAMSHALA, October 14: In the much awaited verdict this afternoon in the high profile case no 20, the Tibetan Supreme Justice Commission (TSJC) ruled in favour of Penpa Tsering, the ousted former representative at the Office of Tibet, Washington DC.

The case was filed in May 2018, largely sparked by publication of a 10-point clarification on official websites of CTA for terminating the service of plaintiff from the Office of Tibet, Washington DC in November 2017.

The verdict that lasted almost five hours in which the Chief Justice Commissioner Kargyu Dhondup went through minutes of the case, the plaintiff was acquitted from the charges formulated as eight issues of law and two issue of facts in the case.

Talking to the media afterwards, the plaintiff said although he won the case, there is no inspiration to celebrate as it is against the cabinet and spoke of the need for measures to prevent such compulsion in the future and for the community to rise above it.

The plaintiff was able to prove all five points where as the defendant team failed to prove any of the 14 points required of it by the court.

The Chief Justice Commissioner held that the defamatory allegations made against the plaintiff were unsubstantiated, ordered the defendant to issue apology and clarification the same way through the CTA official outlet.

The defendant also needs to compensate INR 98,700 for the lawyer fees of the plaintiff.

I am surprised to read that Penpa Tsering has won the case against Lobsang Sangay. I thought Tibetan court will be on Lobsang Sangay's side. For once the Tibetans are practising democracy. This is very encouraging.

Dorje Shugden followers should all stand up and bring the discrimination case to the court. What the Dorje Shugden followers want is to be treated equally like the rest of the Tibetans and to have the ban lifted. The ban is imposed very unlawfully.

To restore the harmony and unity in the Tibetan community, lifting the ban is one of the things the CTA has to do as soon as possible. Many people suffer in the ban, families, friendships and relationships are broken. This should not be allowed.

As usual, Mr Sikyong will get away with whatever crime that he did as he can manipulate the court and all the justice system. This is the degree of corruption in the Tibetan government of Exile. They have no justice and the powerful party can do whatever as they pleased and there will be no consequences for that. This kind of modus operandi is not new to Tibet. It has been like this since the 5th Dalai Lama's time.

The personal assistants of His Holiness the 5th Dalai Lama assassinated the great lama, Tulku Drakpa Gyeltsen and were not convicted even after the truth was exposed. There are many similar cases throughout the history of old Tibet where powerful lamas are being convicted of crimes without evidence and their Ladrangs were confiscated.

So the verdict is out after many, many months of "President" Lobsang Sangay not even bothering to show up at the trial, thumbing his nose at the third pillar of democracy - the judiciary. And the Supreme Court judge, seemingly feeling very uneasy, announced a decision which I think is the only decision there is, one day before his retirement.

There are really no winners here, only a further tarnishing of the image His Holiness' flock in exile, particularly the CTA which is charged with running the secular affairs of the flock.

The judge only give the verdict a day before his retirement to avoid being penalised by the CTA? Will Lobsang Sangay fulfil what the court has instructed him to? Perhaps no. Lobsang Sangay has not been attending the court, it is very unlikely that Lobsang Sangay will follow what the court has ordered him to.

It is also very possible that Lobsang Sangay will appeal to the court for the decision the court has made. Let's see.

Wow... the judge gave the verdict just a day before his retirement? Then that is very obvious like what you say Drolma.... he probably did a risk calculation before executing his verdict. No wonder he is so daring!

I also agree that this Lobsang Sangay is probably going to find ways to ignore, avoid or cut corners so that he does not need to pay the Penpa's lawyers and write a public apology to Penpa. What a slap on his corrupt face! IF he actually does that and if he does it would actually be good for him cos he would appear honest. More honourable this way but would he? I doubt it.

Knowing how arrogant Lobsang Sangay is, I doubt he will do what the court has asked him to do. Perhaps he will try to appeal again. He will not want to lose money and power. Just wait and see what is Lobsang Sangay going to do next.

Typical of Sangay and his cronies to blame the court? I am not surprise by this shameful action of his cabinet. They dare to blame and say that the court gave a biased judgement? When they do that, they are indirectly telling their people not to trust their own judiciary system, only the CTA is right. This is going to obvious create more havoc for them. People are no longer afraid to speak up and quite frankly, I think His Holiness is stepping aside as he should not get involve in politics (unnecessarily) and allowing the people to speak this time, because honestly, Sangay is quite a disappointment and embarrassment, not to mentioned cheater and user of his own people. Well, Penpa isn't any great either but at least he did not misuse the 1.5million "loan" LOL. Karma returns to CTA.

Tibetan Cabinet accepts order to apologise to Penpa Tsering

The Cabinet of the Central Tibetan Administration (CTA) has accepted the verdict of the Tibetan Supreme Justice Commission, but continues to express dissatisfaction at the decision in the defamation case filed by former Representative to Washington DC Penpa Tsering.

Right after the Supreme Justice gave the verdict, the CTA’s Home Minister, Sonam Topgyal convened a press conference to express dissatisfaction with it. He said that the decision was not according to their expectations.

The acceptance has been announced on the official Tibetan-language website of CTA, further stating that the public is feeling saddened by the biased judgment, but still accepting the court’s order for the stability of the administration and unity of the Tibetan people.

The CTA President Lobsang Sangay-led Cabinet has urged the public to take responsibility to maintain peace and order within society.

Now famously known as Case no 20, the case was registered by Penpa Tsering against the 10-point charges issued by the Cabinet blaming Tsering of inefficiency, dereliction of duty, and insubordination.

The top exile Tibetan court cleared plaintiff Penpa Tsering of all charges against him in a verdict given on 14 October, and ordered the Cabinet to issue an apology and pay Tsering’s lawyer fees within a month, which expires on 13 November.

In the verdict, the court found that the charges were baseless, had damaged Penpa Tsering’s dedication, efficiency, and moral grounds, and that wrong information has been propagated against him.

The verdict has ordered the Cabinet to expressly publish in all their bulletins and online publications, in both Tibetan and English, that the Cabinet is offering an apology to Penpa Tsering for the defamation. In addition the published apology must be submitted to court, to be forwarded to Penpa Tsering.

The Cabinet will also have to pay Penpa Tsering’s lawyar Namgyal Tsekyi a sum of rupees 98,000 (1,400 USD approx).
